Terms of Service

HeyKlick is a software-as-a-service product that generates on-brand social media images and (where available) short videos from a product photo and a brief you provide. The Service is delivered entirely online; there are no physical goods. We provide the Service to businesses and individuals worldwide, subject to these Terms and applicable law.

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

The Service runs on credits. 10 credits generate 1 post. Credits are made available through:

• Free plan — 50 credits per month, refreshed monthly, no payment required.
• Subscriptions — Pro ($19/month or $190/year, 500 credits/month) and Studio ($49/month or $490/year, 1,500 credits/month). Plan credits refresh at the start of each billing period and do not roll over.
• Credit top-ups — one-time purchases (100, 300, or 1,000 credits) that do not expire and are consumed after your monthly plan credits.

All prices are in U.S. dollars and exclusive of taxes unless stated otherwise. Current pricing is shown on our pricing page and is incorporated into these Terms.

Payments are processed by our third-party payment processor, Stripe, Inc. We do not store your full card details. By subscribing, you authorize us (through Stripe) to charge your payment method the recurring fee for your selected plan and interval until you cancel. Subscriptions renew automatically at the end of each period (monthly or annual) at the then-current price.

We may change prices or plan features with at least 30 days’ notice for active subscribers; changes take effect at your next renewal. If you don’t agree, you may cancel before the change takes effect.

You can cancel a subscription at any time from your billing settings or via the customer portal. When you cancel, your plan remains active until the end of the current paid period; we do not provide prorated refunds for the unused portion of a billing period unless required by law.

Credits and one-time top-up purchases are non-refundable once credits have been added to your account, except where required by applicable law. If you believe you were charged in error, or you experience a technical failure that consumed credits without producing a usable result, contact us within 14 days at support@heyklick.com and we will review and, where appropriate, re-credit your account.

Generation is typically completed within seconds to a few minutes and the resulting assets appear in your library, available to download. Because outputs are generated by AI, results vary; an occasional generation may fail. Failed generations are not charged, and any credits spent on a generation that does not complete are automatically returned to your balance.

You retain ownership of the images and briefs you upload (“Inputs”). You represent that you own or have the rights to your Inputs and that they do not infringe anyone’s rights. Subject to these Terms and your payment of applicable fees, we assign to you the rights we hold in the assets you generate (“Outputs”) so you can use them commercially. You grant us a limited license to process your Inputs and Outputs solely to operate and improve the Service.

Your generations are private by default — only you can access them unless you choose to share them.

You agree not to use the Service to create, upload, or distribute content that is unlawful, infringing, deceptive, hateful, sexually exploitative (especially involving minors), that impersonates others, depicts identifiable people without consent, or that violates the policies of the platforms you publish to or of our providers. You also agree not to resell, scrape, reverse-engineer, or abuse the Service or attempt to circumvent credit limits, rate limits, or security. We may suspend or terminate accounts that violate this section.

The Service relies on third-party providers including Stripe (payments), as well as authentication, database, cloud storage, and AI model providers used to operate the Service and generate Outputs. Your use of the Service may be subject to those providers’ terms where applicable.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Outputs will be accurate, suitable, or free of similarity to other works, or that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, HeyKlick and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD $100.

You agree to indemnify and hold HeyKlick harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your Inputs, your Outputs, or your breach of these Terms or of applicable law.

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the Service in a way that creates risk or legal exposure for us. Sections that by their nature should survive termination (e.g. payment obligations, IP, disclaimers, liability, indemnity) will survive.

We may update these Terms from time to time. If we make material changes we will provide notice (e.g. by email or in-product). Continued use of the Service after changes take effect constitutes acceptance.

These Terms are governed by applicable law without regard to conflict-of-laws rules, and disputes will be resolved in the courts of competent jurisdiction where HeyKlick is established. Questions about these Terms? Email support@heyklick.com.
